The announcement from the U.S. Department of Justice (DOJ) regarding the creation of a Title IX Special Investigations Team is a significant step forward in addressing the challenges faced by trans athletes and their families in the sports industry. The DOJ, working in collaboration with the Department of Education, aims to tackle the booming number of Title IX cases involving trans athletes, especially as the issue of transgender sports has intensified. This initiative is a response to the previous state policies implemented by President Biden, which allowed trans inclusion in girls’ and women’s sports, despite ongoing concerns about safety, academic disadvantage, and loss of scholarships.

Under President Biden’s administration, the Biden executive order introduced on January 1, 2021, aimed to prevent and combat discrimination on the basis of gender identity or sexual orientation, highlighting the danger of trans inclusion in sports. This led to calls for a transgender bill of rights by Democrats in March 2023, which sought to redefine federal law to ensure that-based inclusive of its scientific boys and fairies. The legislation, also known as the “Federal Government should be development a Transgender Bill of Rights,” proposed that biological men should “participate in sports on teams and in programs that best align with their gender identity…” and “use school facilities that best align with their gender identity.”

On April 21, 2023, the DOJ and DOE proposed a rule that aimed to punish schools for preventing trans athletes from competing in women’s sports, with the title “Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance: Sex-Related Eligibility Criteria for Male and Female Athletic Teams.” This rule, detailed in the annual newsletter “Legal turns away: exploring the implications of the federal_gov_colleges_heads_rule_can_arbitrate.sed_applied_to_teams_athletes.smh,” sought to address the risk associated with federal financial assistance and ensure that schools treat transgender and biological men fairly in athletic activities.
