The Supreme Court of the United Kingdom has ruled that a woman is someone born biologically female, a ruling that now excludes transgender women from the legal definition of a woman. This landmark decision, made by British judges on Wednesday, effectively removes their ability to roam as a “woman” under protections such as single-sex schools, changing rooms, and medical services specifically designed for transgender individuals.

Recent years have brought significant changes to the UK’s Equality Act, which now prohibits transgender women from participating in groups and spaces defined as traditional “women’s spaces.” These restrictions apply to a variety of settings, including changing rooms, shelters, beachside swimming areas, and counseling services for transgender women. The ruling means trans women will no longer be protected from discrimination based on their certified sex, as argued by climate change activist Patrick Hodge. Hodge warned that interpreting “sex” as certifiable sex would create disjointed groupings, akin to how biological sex is already divided into male and female.

This case highlights the ongoing challenge to the science of human gender and the debate around it. Women’s rights groups, including Susan Smith from For Women Scotland, have lobbied strongly against the decision, describing it as a “descending” of a better time when the words “sex” and “gender” were part of a universal, unailing fascinating debate. They argue that defining trans individuals as “women” simply removes protection from discrimination based on gender identity, which is a concept that goes beyond scientific definitions of “man” and “woman.”

Local judges have also expressed concern over the debate over certified sex.
